Trump administration attempts to ban nationwide treatment of trans youth with new federal regulations

Spread the love

Over the past year, the Trump administration has made limiting transgender health care for youth a top priority, seeking to ban treatment for anyone under 19 in both red and blue states. Those tactics have included threatening and subpoenaing providers of trans youth’s medical records, attempting to siphon federal subsidies from hospitals and universities that provide gender-affirming care, and issuing vague guidelines that have forced even longtime allies into overcompliance. Now, the administration is strengthening three new rules that, if enacted, could effectively end treatment for most transgender youth across the country, putting pressure on many health care providers to prevent trans patients from getting the care they need for fear of federal retaliation and punishing those who don’t comply.

no way federal rule confirmed this morning It would disqualify nonprofits for Public Service Loan forgiveness if they “engage in the chemical and surgical castration” of minors. It’s an incendiary statement about what the administration defines as puberty blockers and hormone therapy as standard treatment for transgender youth later diagnosed with gender dysphoria. This change would punish the entire institution. Doctors, nurses, and employees of hospitals, universities, or non-profit organizations that provide gender-affirming care to minors would be ineligible for loan forgiveness, effectively forcing organizations to forgo care or risk the financial security of their employees.

The regulations are scheduled to take effect on July 1, 2026, and are widely expected to face legal challenges. The PSLF statute does not authorize the exclusion of qualified nonprofit employers based on their provision of gender-affirming care. Legal experts point out that the policy is weak under the Administrative Procedure Act. Review of legal rights after Loper Bright. Nonetheless, as seen in previous crackdowns on transgender healthcare, many hospitals, as well as some LGBTQ+ organizations, including Fenway Health in Boston—Choose compliance rather than risk confrontation, highlighting how fear of federal reprisal can weaken resistance even among supposed allies.

The same morning this first rule was confirmed. NPR reported. Two additional rule proposals are expected in the coming days. One would ban federal Medicaid reimbursement for gender-affirming care provided to people under 19 years of age. Another would go further and bar hospitals that treat transgender minors from receiving any Medicaid funds at all. This is a move that effectively eliminates access to such care nationwide except for a small number of private clinics that are able to completely waive Medicaid, which is rare in transgender youth medicine.

The new rules reflect negotiations on fiscal year appropriations bills related to the ongoing shutdown fight. House Republicans are similarly pushing to ban federal funding for gender-affirming care nationwide. As the shutdown drags on, transgender advocates and transgender Americans are closely watching which of its provisions become law. Although closures were primarily centered around a clean and lasting resolution without these provisions. There was a little change This is toward negotiating a full appropriations bill that could become a mechanism for anti-trans and anti-LGBTQ+ provisions to enter federal law. If Trump were able to access even some of the restrictions included in the House bill, it would further legitimize the administration’s efforts to dismantle transgender health care across the country.

Gender reassignment therapy saves lives. no way Cornell Review More than 51 studies have shown that such treatment significantly improves the mental health of transgender people. In one major study 73% drop Suicide rates among trans youth entering treatment; someone else discovered 40% reduction Cases of actual suicide attempts in the previous year. research published in Journal of Adolescent Health In April 2024, puberty blockers were shown to dramatically reduce depression and anxiety. Germans abroad Review supported by 27 health organizations Authorizes gender reassignment care for adolescents; So did the recent French medical consensus.. The evidence is historical resolution The American Psychological Association, which represents 157,000 members, officially condemned the transgender care ban.

If enacted, these regulations will make gender-affirming care for transgender youth much more difficult, if not impossible, to access in most parts of the country. Even now, with only the threat of enforcement at stake, many hospitals and organizations have chosen compliance rather than resistance. If these measures are fully implemented, the chilling impact on transgender healthcare will be immediate and devastating, erasing years of medical advancements and leaving thousands of young people without safe treatment options.
